Abstract

In what cases could the state practice of prohibiting actions and punishing the perpetrators (as offenders) be considered justified from the perspective of a libertarian political theory? This is the question with which the present work begins and also the question that guides the content of it. The libertarian political theory does not support a fair society model but only a normative theory about the conditions in which political authority arises, in a morally justified way, so that in this work, it is intended to show its transcendence as political theory in a criminal subject.
