Abstract

The LO 1/2015, that reforms the Spanish Criminal Law, strengthen the (polemic) political-cri-
minal decision of impose penalties on criminal liability of legal entities, turning the “vicarial” model (con-
figured in 2010) into a “corporate guilt”. In this way, the doubts about constitutionality of the first (that can


be label like vicarial responsibility) are replaced by incompatibly problems between the categories in which
the criminal liability of legal entities are founded and the main concepts of legal theory of crime contents
in the Spanish Criminal Law on the exclusive base of human behavior. At this point, it is possible to sustain
today, with Criminal Law on hand that is possible to impose penalties on legal entities.
