Abstract

The present study’s focus is on the recruitment of child soldiers in situations where there is no armed conflict, but there is a need for criminal persecution. To this end, an account is made of the regulation of this conduct in international law, which allows its scope to be determined. The idea is to incorporate this practice as “other inhumane act”, a crime against humanity within the meaning of article 7(1) (k) of the Rome Statute. To this end, a procedure is drawn up, on the basis of international jurisprudence, by virtue of which recruitment of child soldiers could be incorporated into the broad wording of the Rome Statute, pointing out the requirements and scope necessary to make this argument legally feasible.
