Elementos del Common Law en el Derecho Penal Internacional

Abstract

This paper compares different criminal types and selected figures from fundamental criminal law found in Common Law and in international criminal law in order to find out how this law tradition has influenced this branch of international law. After examining juristic writings and judicial decisions the author comes to the conclusion that this influence has not been as considerable as commonly thought. Nonetheless Common Law can provide several tools for systematization and analysis that could contribute to a better understanding of international criminal law
