Abstract

The legal basis of the liability of legal entities has generated a controversial debate on its nature, basis, and defining elements, in which jurisprudence interpretation is of the most importance. The purpose of this study is to analyse some problems of this legislation on which the Supreme Court has had occasion to rule, in light of constitutional criminal principles, particularly, legality principle and culpability principle.
