¿Tiene la culpa el sistema penal acusatorio?

Abstract

On July 5, the First Chamber of the Supreme Court of Justice of the Nation resolved a contradiction of thesis in which it established that the accused who are in criminal proceedings, according to the rules of the previous inquisitorial system, can access certain benefits of the new system in relation to their rights. The head of government Miguel Angel Mancera was against the resolution because it allows some inmates subject to process to continue their process in freedom. In this way, the present article analyzes the figure of preventive detention and the terms for the resolution of the supreme court.
