Abstract

The International Criminal Court (ICC) is a court whose function is to prosecute and judge the so-called core crimes. In this sense, this article exposes the importance of this legal figure which has great challenges in the selection and prioritization of cases which must be treated in a rational, fair and transparent manner since they are key elements for the operation and legitimacy of this international criminal system. The author compares the real criminal system with an ideal approach, differentiating retributive justice from distributive justice.
